1. Agreement to Terms
These Terms and Conditions ("Terms") govern your use of the CreditProSAI website and software platform (the "Service"), operated by NCES CONSULTING SERVICES (d/b/a CreditProSAI) ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.
2. Description of Service
CreditProSAI is a cloud-based credit repair software platform that provides consumers with tools to manage the credit repair process, including dispute letter generation, credit report analysis, and integration with third-party credit monitoring services. We are a software provider, not a credit repair organization, financial advisor, or legal counsel.
3. SMS Terms
By providing your phone number and consenting to receive SMS messages, you agree to the following SMS terms:
- You agree to receive SMS messages related to your account and services from CreditProSAI.
- SMS consent is not a condition of purchasing any goods or services from CreditProSAI.
- You may cancel SMS messages at any time by replying STOP to any message you receive.
- Replying HELP provides support instructions and contact information.
- Message frequency varies. Message and data rates may apply according to your mobile carrier plan.
4. User Accounts
To access certain features, you must register for an account. You agree to provide accurate information and keep it current, and you are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
5. Fees and Payment
Certain aspects of the Service may be provided for a fee. By selecting a paid plan, you agree to pay all applicable fees as described on the Service. All fees are non-refundable except as required by law. We may change fees with advance notice before changes take effect.
6. User Responsibilities
You are solely responsible for the accuracy of the data you provide. You agree to use the Service only for lawful purposes. You are responsible for independently verifying any dispute letters generated by the software before sending them. CreditProSAI is not responsible for errors or consequences arising from letters generated by the Service.
7. Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Results from using our Service are not guaranteed and will vary based on individual circumstances and effort.
8. Limitation of Liability
In no event shall NCES CONSULTING SERVICES (d/b/a CreditProSAI), its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of the Service.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
